Terms & Conditions

These are Terms and Conditions which outline the obligations and responsibilities of the users on www.Task2Bid.com (hereinafter referred to as the “Task2Bid”).

Task2Bid is an online platform connecting users who are requesting for services and users who are providing services.

All users are deemed to have read and understood all Task2Bid policies including the Privacy Policy and the Community Ethics before using the Task2Bid platform.

Definitions

"Agreed Price" means price agreed for the services by the Users (including any variation) which is paid into Task2Bid Account made by the Task Requester.
"Agreement" means the most updated version of the agreement between Task2Bid and a User.
"Bid" means a bidding amount made by the Task Doer to perform and complete any Task offered by the Task Requester.
"Business Day" means general business working days in Malaysia, except on Saturday, Sunday or Public Holiday.
"Cancellation Fee" means the Fee payable by the Task Requester for cancelling the Task Contract.
"Consequential Loss" means any expenses, losses or damages recoverable at law:

other than a expenses, losses or damages that would be suffered or incurred by any person in a similar situation to the person suffering or incurring the expenses, losses or damages; or
which is a loss of:
business, value of any equipment, profits, opportunities, anticipated savings, data or any other cost incurred in connection with the foregoing.

"Fees" means all payable amount to Task2Bid by Users which also includes the Management Fee.
"Identity Verification" means Users verification such as mobile phone verification, Identity Card/ Passport/ Driving License verification and integration with social media.
"ipay88 Provider" means a third-party payment gateway used by Task2Bid platform to facilitate payments.
"Management Fee" means the payable amount subject by the Task2Bid to Task Doer upon agreeing Task Contract.
"Non-excludable Condition" means any implied condition, warranty or guarantee in a contract, the exclusion of which would contravene the law or cause any part of the contract to be void.
"Policies" means any policies updated in Task2Bid platform including Community Ethics and Privacy Policy.
"Posted Task" means the details of the Task such as title, description, budget and deadline posted by the Task Requester.
"Personal Data" has the same meaning as provided by the Personal Data Protection Act 2010.
"Privacy Policy" please refer here - https://task2bid.com/privacy-policies
"Services" means the task descriptions as requested by the Task Requestor, including any changes agreed before or subsequent to the agreeing of the Task Contract.
"Sticker" means a sticker that may be issued to the User based on the User meeting certain qualifications or other thresholds, as determined and set by Task2Bid.
"Task Contract" means the contract which shall be agreed by the Task Requestor and Task Doer upon accepting the Services.
"Task Doer Funds" means the Agreed Price minus the Management Fee.
"Task Doer" means the User who provides Services to the Task Requesters.
"Task Requester" means the User who posts Services on the Task2Bid Platform.
"Task2Bid Account" means the Task2Bid account.
"Task2Bid Platform" means the Task2Bid website at https://www.task2bid.com/, Task2Bid smartphone app, and any other affiliated platform that may be introduced from time to time.
"Task2Bid" "we" "us" "our" means Task2Bid and its parent company ASIATECHUB SDN BHD 1272362-A.
"Third Party Service" means the services offered by third parties as may be featured on the Task2Bid Platform from time to time. This may include third party insurance and third party payment gateway.
"User" means an individual who has signed up to use the Task2Bid Platform, whether as the Task Requester, Task Doer, or otherwise.

SCOPE OF TASK2BID SERVICES
Task2Bid allows a Task Requester to publish a Posted Task on the Task2Bid platform.
A Task Doers may then make a Bid in response to a Posted Task. Parts of the details of the Posted Tasks are available publicly, including to those internet users who are not Task2Bid Users.
A Task Requester may revoke or modify the Posted Task at any time before the Bid is accepted. Task2Bid reserves the right to cancel all Bids on a Posted Task made prior to the modification and/she accepts the Bid. Task2Bid reserves the right to cancel all Bids on a Posted Task made prior to the modification or amendment.
If a Task Requester accepts the Bid on the Task2Bid Platform, a Task Contract is formed between the Task Requester and the Task Doer. The Task Requester must then pay the Agreed Price into the Task2Bid Account.
At time when a Task Contract is formed, Task2Bid is deemed to have rendered its Services, and the Management Fee is due and payable.
The Task Doer and Task Requester may change the Task Contract on the Task2Bid Platform after its formation. The Task Requester and Task Doer are encouraged to use the private messaging system on Task2Bid Platform to modify or amend the Task Contract (this includes the Agreed Price) or otherwise to communicate.
The Task Doer must render the Services required under the Task Contract, this includes any additional terms or conditions that has been agreed by the both parties.
Upon completion of the Services, The Task Doer shall request for the Task Completion Form on the Task2Bid Platform by providing proof of rendering the Services (which may include taking photo with the Task Requester or with the results of the Services provided).
The Task Requester shall accept the Task Completion Form upon completion of the Services on the Task2Bid Platform if the Task Requester is satisfied with the work of the Task Doer.
Once the Posted Task has been completed and the Task Requester confirms the Services have been completed and the proof of rendering the Services has been submitted, or if Task2Bid is satisfied that the Services have been completed, the Task Doer Funds shall be released from the Task2Bid Account.
After the Task Contract has been completed, Task Requester shall review and provide a feedback on the Services provided by the Task Doer on the Task2Bid Platform.
TASK2BID'S ROLE AND OBLIGATIONS
Task2Bid is only providing the Platform to enable Users to publish Posted Tasks and for a Task Doer to make Bids on the Posted Tasks.
Users shall be above the legal age of 18.
Users must be natural persons but may specify in their account description if they are representing a business entity.
Task2Bid has the absolute discretion to allow or refuse any person to register or create an account with Task2Bid; and to cancel or suspend any existing account.
It is free to register and create an account with Task2Bid. A Task Requester and Users reviewing the content on the Task2Bid Platform (including Posted Task) shall not be charged.
Task2Bid shall not be liable for any interactions between the Task Requester and the Task Doer, including, but not limited to the description, performance or delivery of the Services.
Task2Bid has no responsibility and makes no warranty as to the accuracy or certainty of any aspect of any information provided by Users, including, but not limited to, the ability of Task Doers to perform tasks or supply items, or the honesty or accuracy of any information provided by Task Requesters or the Task Requesters' ability to pay for the Services requested.
Except for liability in relation to any Non-excludable Condition, the Task2Bid Service is provided on an “as is” basis, and without any warranty or condition, express or implied.
To the extent permitted by law, we specifically disclaim any guarantee by the Task Doer to the Task Requester on any transfer of property or any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement.
Task2Bid has no obligation to be involved or to assist in any dispute between the Users, although we may do so to enhance User experience.
USER OBLIGATIONS
Users shall at all times:
comply with this Agreement (including all Policies) and all applicable laws and regulations;
only post accurate information on the Task2Bid Platform;
perform obligations to other User under a Task Contract promptly and efficiently; and
aware of any laws that apply to User as a Task Requester or Task Doer, or in relation to using the Task2Bid Platform.
Users agree that any content (whether provided by Task2Bid, a User or a third party) on the Task2Bid Platform shall not be used on a third party sites or for other business purposes without prior notice and approval from Task2Bid.
Task2Bid Platform shall not be used for any illegal or immoral purpose.
Users shall manage their Task2Bid account personally. User are not allowed to transfer or sell the Task2Bid account (or any of its content).
Users grant Task2Bid an unrestricted, worldwide, royalty-free licence to use, reproduce, modify and adapt any content and information posted on the Task2Bid Platform for the purpose of publishing material on the Task2Bid Platform and as otherwise may be required to provide the Task2Bid Service, for the general promotion of the Task2Bid Service, and as permitted by this Agreement.
Users agree that any information posted on the Task2Bid Platform must not, in any way whatsoever, be potentially harmful to Task2Bid or any other person. Harm includes, but is not limited to, economic loss that will or may be suffered by Task2Bid.
Without limiting any provision of this Agreement, any information the Users supply to Task2Bid or publish in a Posted Task (including as part of a Bid) must be kept up to date and should not:
be false, inaccurate, misleading or deceptive;
be fraudulent or involves the sale of any counterfeit or stolen items;
infringe any third-party copyrights, patent, trademark, trade secret or other proprietary rights or intellectual property rights, rights of publicity, confidentiality or privacy;
violate any applicable law, regulation (including, but not limited to, those governing export and import control, consumer protection, unfair competition, criminal law, antidiscrimination and trade practices/fair trading laws);
be defamatory, libellous, threatening or harassing;
be obscene or contain any material that, in Task2Bid's sole and absolute discretion, is in any way inappropriate or unlawful, including, but not limited to obscene, inappropriate or unlawful images; or
contain any malicious code, data or set of instructions that intentionally or unintentionally cause harm or subverts the intended function of any Task2Bid Platform, including, but not limited to viruses, trojan horses, worms or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or Personal Data.
Task2Bid Platform may from time to time engage location-based or map-based functionality. The Task2Bid Platform may display the location of Task Requesters and Task Doers to persons browsing the Task2Bid Platform. Each Task Requester will be asked to provide the street, postcode and city where the Services are to be delivered. A Task Requester should never disclose personal details such as the Task Requester's full name, street number, phone number or email address in a Posted Task or in any other public communication on the Task2Bid Platform.
Task Doers must provide Services to Task Requesters in accordance with the Task Contract, unless the Services are prohibited by law, this Agreement, an agreement between the User and a third party or by any of our Policies.
Users must not, when supplying Services, charge a Task Requester any fees on top of the Agreed Price which were agreed upon. However, the parties to a Task Contract may agree to amend on the Agreed Price through the Task2Bid Platform.
Users must not claim any payments outside of the Task2Bid Platform from the Task Requester except to the extent permitted by clause 3(XII) and only if the Task2Bid Platform does not facilitate the reimbursement via the Task2Bid Account of costs considered in clause 3(XII).
If a Task Doer agrees to pay some costs to complete the Services (such as equipment to complete Services), the Task Doer is solely responsible for obtaining any reimbursement from the Task Requester. Task2Bid advises Task Doers not to agree to incur any costs in advance of receiving the payment for these costs, unless the Task Doer is confident that the Task Requester will reimburse the costs promptly.
If Task2Bid determines at its sole discretion that a User has breached any obligation under this clause 3, it reserves the rights to remove any content, Posted Task or Bid the User has submitted to the Task2Bid Service or cancel or suspend the User's account and/or any Task Contracts.
FEES
Task2Bid Account is fully controlled and managed by ASIATECHUB SDN BHD and Task2Bid User as Task Doer authorises ASIATECHUB SDN BHD to collect and hold the payment until the Task Requester approves and submits the Task Completion Form.
Upon the creation of a Task Contract, the Task Doer owes Task2Bid the Management Fee. The Management Fee will automatically be deducted from the total payment amount.
The Task Doer can only withdraw their balance amount from the Task2Bid Account once it has accumulated to a minimum credit of RM20 in the Task2Bid Account.
Task2Bid uses Interbank GIRO (IBG) fund transfer payment system which allows the transfer of money and credit the next business day.
Task2Bid may release the payment by end of the week upon the Task Doer's request for fund withdrawal by end of Wednesday on the same week.
If the Posted Task requires a Task Doer to incur further costs in completing the Services, the costs incurred will not be included in any calculation of Fees.
The Task Doer and Task Requester shall amend the Agreed Price if there are any further costs incurred during the completion of the Services.
Fees payable does not include any additional fees that may be due to Third Party Service providers. All Third-Party Service providers are paid pursuant to a User's separate agreement with that Third-Party Service provider.
All Fees and charges payable to Task2Bid are non-cancellable and non-refundable, subject to the Users' rights under any Non-Excludable Conditions.
If Task2Bid introduces new services on the Task2Bid Platform, the Fees applicable to those services shall be payable from the launch of the services.
Task2Bid may set-off any Fees against any Task Doer Funds or other amounts held by Task2Bid on behalf of a User.
Task2Bid may restrict a User's account until all Fees are paid.
PAYMENTS AND REFUNDS
If:
the Task Doer cancels the Task Contract; or
the Task Doer fails to perform the Task Contract despite reasonable attempts by a Task Requester to contact the Task Doer, the Task Contract is deemed cancelled;
Task2Bid is satisfied that the Agreed Price should be returned to the Task Requester,
then, Task2Bid will pay the Task Doer Funds held in the Task2Bid Account to the Task Requester.
Any Management Fee in accordance with clause 4(I), paid by Task2Bid on behalf of a Task Doer under clause 5(I) will be a debt owed by the Task Doer to Task2Bid.
The cancellation will be attributed to the Task Doer unless the Task Doer can provide evidence to Task2Bid and it will in its discretion decide whether the Task Requester caused the cancellation of the Task Contract.
If a Task Contract is cancelled by Task Requester:
the Task Requester must pay the Cancellation Fee. The Cancellation Fee will be 15% in addition to the Management Fee based on Task Contract. This Cancellation Fee will be rewarded to the Task Doer.
Cancellation Fee possible to above 15% (not above the total Task Budget excluding Management Fee) if the doer able to justify the damage cost
If a Task Contact is cancelled in accordance with clause 5(I) and 5(IV), Task2Bid may take up to 14 days to return the Agreed Price (after deduction of the Cancellation Fee, if applicable) to the Task Requester.
If for any reason:
Task Doer Fund cannot be transferred to The Doer bank account; or
Task Doer account suspended (for any reasons) with an accumulated minimum fund of RM 50 or less than minimum fund;
then, the Task Doer Fund will remain in the Task2Bid Account until it is paid or otherwise for up to 1 year.
Any unclaimed fund as referred to in clause 5(VI), will be transferred to the Unclaimed Money Registrar (as the case may be) in accordance with the applicable laws.
PAYMENT FACILITY
Task2Bid uses ipay88 Provider as its payment provider to operate the Task2Bid Account.
In so far as it is relevant to the provision of the ipay88 Provider, the terms found at http://www.ipay88.com/agreement/myrgateway/merchant_agreement.asp are incorporated into this Agreement and will prevail over this Agreement to the extent of any inconsistency in relation to the provision of the Task2Bid Account.
If Task2Bid changes its payment provider or ipay88 Provider, the User may be asked to agree to additional terms with those providers.
MEDIATION AND DISPUTE RESOLUTION
Task2Bid encourages its Users to try and resolve disputes (including claims for returns or refunds) with other Users directly. Accordingly, the Users acknowledge and agree that Task2Bid may, in its absolute discretion, provide the Users' information as it decides is suitable to other parties involved in the dispute.
If a dispute arises with another User, a User must co-operate with the other User and make a genuine attempt to resolve the dispute.
Task2Bid may elect to assist Users resolve disputes. Any User may refer a dispute to Task2Bid. All Users must co-operate with any investigation undertaken by Task2Bid. Task2Bid reserves the right to make a final determination (acting reasonably) based on the information supplied by the Users and direct the Task2Bid Account to make payment accordingly.
Task2Bid has the right to hold any Agreed Price that is the subject of a dispute in the Task2Bid Account, until the dispute has been resolved.

In the event Task2Bid provides information about other Users to the complaining User for the purposes of resolving disputes under this clause, it is deemed that that such information will be used only for the purpose of resolving the dispute (and no other purpose) and Task2Bid shall be indemnified against any claims relating to any other use of information not permitted by this Agreement.
If Task Contract agreed by both parties in the event of dispute after investigation 15% of Management Fee will be deduced from the Doer/Requester.
VERIFICATION & STICKERS
Task2Bid may use Identity Verification Services.
Users agree that Task2Bid Identity Verification Services may not be fully accurate as all Task2Bid Services are fully dependent on the information supplied by the Users.
Users are solely responsible for identity verification and Task2Bid accepts no responsibility for any use that is made on any Task2Bid Identity Verification Service.
Task2Bid Identity Verification Services may be modified at any time.
The Task2Bid Platform may also include a User-initiated feedback system to help evaluate Users.
Users acknowledge that Stickers are point in time checks and may not be accurate at the time it is displayed. Users should seek to verify any Sticker with the Task Doer prior to commencing the task.
It remains the Task Doer's responsibility to ensure that information or documentation it provides in obtaining a Sticker is true and accurate and must inform Task2Bid immediately if a Sticker is no longer valid.
Task2Bid retains the discretion and right not to issue, or remove without notice, any Sticker if the User is in breach of any of the terms of this Agreement, the Sticker has been issued incorrectly, obtained falsely, has expired, is no longer valid or for any reason requiring its removal by Task2Bid.
INSURANCE
Task2Bid will obtain insurance for certain Task Contracts and such insurance will be offered by a third party, Allianz Malaysia Berhad. Task2Bid confirms that all insurance policies are Third Party Services and they are subject to further terms set out for Third Party Services.
The insurance policy only covers the damages in the Task Requester's property and the Task Requestor's valuable belonging in the event of theft in the Task Requester's property. The insurance policy specifically provides for the list of subcategory tasks under the category of “Home & Garden” on the Task2Bid website.
The insurance policy is only available for Task Contracts with the Agreed Price more than RM100.00.
In order to substantiate the claim, the Users are advised to take photos and video throughout the task duration to be used as evidence in the event of making an insurance claim.
In the event of any incident caused by the Users, the User should make a police report within 24 hours from the time of the incident.
After making the police report, the Users should submit a copy of the police report to Task2Bid within 24 hours from the making of such report.
The insurer agrees to indemnify the insured for damages in Task Requester's property up to the amount of maximum RM1,000.00 AOO/ RM10,000.00 AGG if it is proven that the damages was caused by the Task during the time of carrying the Task Doer at the Task Requester's property.
The insurer agrees to indemnify the insured for theft losses of valuable belongings of the Task Requester up to the amount of maximum RM1,000.00 AOO/ RM10,000.00 AGG if it is proven that it has been stolen by the assigned Task during the time of carrying out the Task Doer at the Task Requester's property.
FEEDBACK
Users may complain about any comment made on the Task2Bid Platform using the 'Report' function of the Task2Bid Platform or contact Task2Bid via the Task2Bid Platform.
Task2Bid is entitled to suspend or terminate the User's account at any time if Task2Bid, in its sole and absolute discretion, is concerned by any feedback about the User, or considers the User's feedback rating to be controversial for other Task2Bid Users.
LIMITATION OF LIABILITY
Except for liability in relation to breach of Non-excludable Condition, to the extent permitted by law, Task2Bid disclaims all liability for any loss or damage (actual, special, direct, indirect or consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed (including, without limitation, loss or damage relating to any inaccuracy of information provided, or the lack of fitness for purpose of any goods or service supplied), arising out of or in any way connected with any transaction between Task Requesters and Task Doers.
Except for liability in relation to a breach of any Non-excludable Condition, and to the extent permitted by law, Task2Bid is not liable for any Consequential Loss arising out of or in any way connected with the Task2Bid Services.
Except for liability in relation to a breach of any Non-excludable Condition, Task2Bid's liability to any User of the Task2Bid Service is limited to the total amount of payment made by that User to Task2Bid or any incident causing liability of Task2Bid, or RM50, whichever is greater.
Task2Bid's liability to its Users for a breach of any Non-excludable Condition (other than a Non-excludable Condition that by law cannot be limited) is limited, at our option to any one of resupplying, replacing or repairing, or paying the cost of resupplying, replacing or repairing goods in respect of which the breach occurred, or supplying again or paying the cost of supplying again, services in respect of which the breach occurred.
PRIVACY
Task2Bid's Privacy Policy, which is available at https://task2bid.com/privacy-policies, applies to all Users and forms part of this Agreement. Use of the Task2Bid Platform confirms that the Users consent to, and authorise, the collection, use and disclosure of the Users' Personal Data in accordance with Task2Bid's Privacy Policy.
Task2Bid will endeavour to permit you to transact anonymously on the Task2Bid Platform. However in order to ensure Task2Bid can reduce the incidence of fraud and other behaviour in breach of the Neighbourhood Practices, Task2Bid reserves the right to ask Users to verify themselves in order to remain a User.
MODIFICATIONS TO THE AGREEMENT
Task2Bid may modify this Agreement or the Policies (and update the Task2Bid pages on which they are displayed) from time to time. Task2Bid will send notification of such modifications to the Users' Task2Bid account or advise the Users the next time they login.
When the Users actively agree to amended terms (for example, by clicking a button saying "I accept") or use the Task2Bid Platform in any manner, including engaging in any acts in connection with a Task Contract, the amendments will be effective immediately. In all other cases, the amended terms will be effective 24 hours after they are initially notified to the Users.
If the Users do not agree with any changes to this Agreement (or any of our Policies), the Users must either terminate their account immediately or notify Task2Bid who will then terminate their Task2Bid Account and prevent them from using the Task2Bid Service.
NO AGENCY
No agency, partnership, joint venture, employee-employer or other similar relationship is created by this Agreement. In particular, the Users have no authority to bind Task2Bid, its related entities or affiliates in any way of any kind.
Task2Bid confirms that all Third-Party Services that may be promoted on the Task2Bid Platform are provided solely by such Third-Party Service providers. To the extent permitted by law, Task2Bid specifically disclaims all liability for any loss or damage incurred by the Users in any manner due to the performance or non-performance of such Third-Party Service.
NOTICES
Except as stated otherwise, any notices must be given by email. Any notice shall be deemed given:
if sent by email, 24 hours after email is sent, unless the Users is notified that the email address is invalid or the email is undeliverable.
TERMINATION
Task2Bid may terminate the Task2Bid Account and this Agreement at any time for any specific reason.
Termination of this Agreement does not affect any Task Contract that has been formed between Task2Bid Users. If the Users have entered a Task Contract, they must comply with the terms of that Task Contract including providing the Services or paying the Agreed Price as applicable.
Main Clause 4 (Fees), 7 (Mediation and Dispute Resolution) and 11 (Limitation of Liability) and any other terms which by their nature should continue to apply, will survive any termination or expiration of this Agreement.
If the Task2Bid Account or this Agreement is terminated for any reason, then the User shall not create any further accounts without Task2Bid's consent, and we may terminate any other accounts the User operates.
GENERAL
This Agreement is governed by the laws of Malaysia. The Users and Task2Bid submit to the exclusive jurisdiction of the courts of Malaysia.
The provisions of this Agreement are severable, and if any provision of this Agreement is held to be invalid or unenforceable, such provision shall be removed and the remaining provisions will be enforceable.
This Agreement may be assigned or novated by Task2Bid to a Third-Party without the Users' consent. In the event of an assignment or novation, the Users will remain bound by this Agreement.
This Agreement sets out the entire understanding and agreement between the Users and Task2Bid with respect to its subject matter.
